- Technical maintenance, preventative servicing, site assessments, and general mechanical works.
- Flexible asset financing packages for residential, commercial, and agricultural clients.
2. Account Registration and Online Shop Orders
- Account Integrity: If you set up a user profile in our online shop, you are solely responsible for maintaining the confidentiality of your login credentials and tracking all activity under your account.
- Order Acceptance: All orders placed through our e-commerce system or confirmed via an official sales quotation are subject to technical verification and product availability. We reserve the right to cancel an order if hardware inventory is constrained or if field conditions prevent a viable setup.
- Currency and Pricing: All prices listed across our services are denominated in Kenyan Shillings (KES). If an item is published with an incorrect price due to a system layout error, we retain the right to cancel orders placed under the erroneous valuation.
3. Equipment Installation & Site Access Conditions
When purchasing a customized solar configuration or water pumping solution that includes on-site installation, the following conditions apply:
- Site Preparation & Assessment: The client must provide accurate property layout boundaries and structural structural information. If our engineers discover unmapped structural issues, compromised roof integrity, or inadequate borehole yields, work may be paused until the client resolves the issue at their own expense.
- Permits and Clearances: Unless explicitly itemized as a line item within your customized service quote, the client holds full responsibility for securing neighborhood, community, or local government clearances required for structural solar or agricultural installations.
- Technical Access: The client must grant our authorized technical teams safe, unhindered access to the installation area during predefined engineering timelines.
4. Financing Models: PAYGO and Lipa Pole Pole
To maximize green energy accessibility across Kenya, we offer flexible Pay-As-You-Go (PAYGO) and Lipa Pole Pole payment options subject to strict asset guidelines:
- Retention of Title: All solar panels, smart inverters, lithium batteries, borehole pumps, and associated accessories remain the exclusive property of Solar Harvest Kenya until the entire purchase price, installation balances, and any agreed service charges are fully paid off.
- Remote Disabling Controls: Our automated financing units run embedded smart meter control switches. If a payment installment is missed or significantly delayed, the system will automatically disconnect power or lock output operations remotely. Solar Harvest Kenya is explicitly clear of liability for any agricultural crop loss, dairy spoilage, or household power disruptions caused by an automated billing lockout.
- Repossession Clearances: If an installment balance remains delinquent for more than 60 consecutive days, Solar Harvest Kenya reserves the legal right to enter the client’s premises during standard business hours to de-install and repossess all company-owned hardware. Initial deposits and historical micro-payments will be retained to cover installation labor and component depreciation.
5. Hardware Warranties & Technical Tampering
- Manufacturer Components: Primary infrastructure units (such as high-efficiency panels and solar inverters) carry independent factory warranties issued straight by original manufacturers. Solar Harvest Kenya coordinates warranty routing but does not issue standalone product replacements outside of manufacturer terms.
- Workmanship Guarantee: We supply a dedicated structural and installation workmanship warranty on our setups, explicitly itemized inside your final contract. This coverage is nullified immediately if any third-party mechanic or unapproved operator modifies, tampers with, or services the grid link without our formal written sign-off.
6. Limitation of Liability
To the fullest extent permitted under the laws of Kenya, Solar Harvest Kenya, its management, and operational staff shall not be held liable for any indirect, incidental, or consequential damages—including business down-time, lost agricultural yields, well drying, or financial revenue shortfalls—resulting from your choice of equipment, installation timelines, or website service accessibility.
7. Governing Law
These Terms, along with all separate product fulfillment or engineering agreements executed with us, shall be interpreted and governed in complete alignment with the statutory laws of the Republic of Kenya. Any legal gridlocks or unresolved claim evaluations shall be handled through courts of competent jurisdiction located in Nairobi, Kenya.
8. Changes to Terms of Service
We reserve the unilateral right to update, modify, or rewrite any structural layout of these Terms by publishing revised documentation directly to our website layout.
